2. Data processing on our website

2.1 Access data and hosting

Each time you visit our website, we collect the access data that your browser automatically transmits in order to enable you to visit the website. The access data includes in particular:

  • Your IP address
  • Name of the requested file
  • Date and time of the request
  • amount of data transferred
  • requesting provider
  • Information about the browser and operating system used
  • online identifiers (e.g. device identifiers, session IDs)

The data processing of this access data is evaluated exclusively for the purpose of ensuring trouble-free operation of the site and improving our offer. The access data is also temporarily stored in internal log files for the purposes described above in order to compile statistical data on the use of our website in order to further develop our website with regard to the usage habits of our visitors (e.g. if the proportion of mobile devices used to access the site increases).

As part of processing on our behalf, a third-party provider provides us with the services for hosting and displaying the website: qwertiko (qwertiko GmbH, Waldstraße 41-43, 76133 Karlsruhe). This serves to safeguard our legitimate interests in the correct presentation of our website, which outweigh our interests. All data collected in the course of using this website is processed on its servers. Processing on other servers only takes place within the framework explained here.

qwertiko is located within a country of the European Union or the European Economic Area. We have concluded a corresponding agreement with this service provider for order processing in accordance with Art. 28 GDPR.

2.3 Contact us

We collect personal data if you voluntarily provide it to us when contacting us (e.g. via contact form or e-mail) or when opening a customer account. Mandatory fields are marked as such, as in these cases we need the data to process your contact or open the customer account and you cannot complete the account opening or send the contact without providing it. Which data is collected can be seen from the respective input forms. We use the data provided by you in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR for contract processing and processing your inquiries. After complete deletion of your customer account, your data will be restricted for further processing and deleted after expiry of the retention periods under tax and commercial law, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration. Deletion of your customer account is possible at any time and can be done either by sending a message to the contact option described below or via a function provided for this purpose in the customer account.

3. Cookies

3.1 Own Cookies

For some of our services, it is necessary for us to use so-called cookies. A cookie is a small text file that is stored on your device by the browser. Cookies are not used to run programs or download viruses to your computer. 3.2 Matomo

We use the open source analysis software Matomo on our website for the statistical analysis of visitor access. Matomo is operated on our servers and no data is passed on to third parties (e.g. Matomo). The IP address processed to record your visit is immediately anonymized (the last 2 bytes of your IP address are anonymized). Only the anonymized IP address is used to process and store your visit. The following data may be stored in the visitor log together with a pseudonymized visitor ID (a device fingerprint):

  • Anonymized IP address
  • Pages accessed (date, time, URL, title, duration of visit)
  • Downloaded files
  • Links clicked on to other websites
  • Operating system
  • Browser type, version and language
  • Device type, brand, model and resolution
  • Approximate location (based on anonymized IP address)
  • Referrer URL (previously visited page)

Visitor logs are automatically deleted after seven days, daily reports after 24 months.

You can prevent the recording of your visit by setting your browser accordingly (Do Not Track) (see the explanations in the previous section) or use the following opt-out button. This creates a deactivation cookie so that the Matomo script is no longer executed. If no opt-out button is displayed below, it is probably blocked by an ad blocker or similar technology in your browser – in this case, check your browser settings.

4. Online presence in social media

We maintain online presences in social networks in order to communicate with customers and interested parties and to provide information about our products and services.

User data is generally processed for market research and advertising purposes. For example, user profiles can be created based on the interests of users. Cookies and other identifiers are stored on users’ computers for this purpose. Based on these user profiles, advertisements are then placed within the social networks and on third-party websites, for example.

When using social networks, users’ personal data may be processed outside the European Economic Area. In order to ensure the comprehensive protection of your data in this case as well, there are sufficient guarantees or other instruments in place to ensure compliance with European data protection principles.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f GDPR, based on our legitimate interest in effective user information and communication with users. The legal basis for the data processing carried out by the social networks on their own responsibility can be found in the data protection information of the respective social network. The links below will also provide you with further information on the respective data processing and the options to object. We would like to point out that data protection requests can be made most efficiently with the respective provider of the social network, as only these providers have access to the data and can take appropriate measures directly.

5. Facebook fan page

We operate a page (fan page) on the social network Facebook, which is offered for users outside the USA and Canada by Facebook Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”) and for all other users by Facebook Inc., 1601 Willow Road, Menlo Park, California 94025, USA (“Facebook”) in joint responsibility with Facebook, in order to communicate with followers (such as our customers and interested parties) and to provide information about our products and services.

In doing so, we may receive statistics from Facebook on the use of our fan page (e.g. information on numbers, names, interactions such as likes and comments as well as summarized demographic and other information or statistics). You can find more information on the type and scope of these statistics in the Facebook notices and corresponding help pages. Further information on the respective responsibilities can be found in the information on Page Insights. The legal basis for this data processing is Art. 6 para. 1 lit. f GDPR based on our aforementioned legitimate interest.

We have no influence on data that is processed by Facebook under its own responsibility in accordance with Facebook’s terms of use. However, we would like to point out that when you visit the fan page, data about your usage behavior is transferred from Facebook and the fan page to Facebook. Facebook itself processes the aforementioned information in order to compile more detailed statistics and for its own market research and advertising purposes, over which we have no influence. You can find more information on this in Facebook’s data policy. In the event that personal data is transferred to the USA, there are sufficient guarantees or other
guarantees or other instruments that ensure compliance with the European data protection principles in order to sufficiently guarantee the protection of your data in this constellation as well.

If we receive your personal data when operating the fan page, you are entitled to the rights set out in this privacy policy. 6. Passing on the data

The data collected by us will only be passed on if:

    • you have given your express consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR,
    • the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR is necessary for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,

we are legally obliged to disclose your data pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR or

  • this is legally permissible and required under Art. 6 para. 1 sentence 1 lit. b GDPR for the processing of contractual relationships with you or for the implementation of pre-contractual measures that are carried out at your request.

Some of the data processing may be carried out by our service providers. In addition to the service providers mentioned in this privacy policy, this may include, in particular, data centers that store our website and databases, IT service providers that maintain our systems, and consulting companies. If we pass on data to our service providers, they may only use the data to fulfill their tasks. The service providers have been carefully selected and commissioned by us. They are contractually bound by our instructions, have suitable technical and organizational measures in place to protect the rights of the data subjects and are regularly monitored by us. 7. Storage duration

In principle, we only store personal data for as long as necessary to fulfill contractual or legal obligations for which we have collected the data. We then delete the data immediately, unless we still need the data until the statutory limitation period expires for evidence purposes for civil law claims or due to statutory retention obligations.

For evidence purposes, we must retain contract data for three years from the end of the year in which the business relationship with you ends. Any claims expire at the earliest at this time in accordance with the statutory limitation period.

Even after this time, we still have to store some of your data for accounting reasons. We are obliged to do so due to
statutory documentation obligations that may arise from the German Commercial Code, the German Fiscal Code, the German Banking Act, the German Money Laundering Act and the German Securities Trading Act. The periods specified there for the retention of documents are two to ten years.

8. Contact options and your rights

You have the right to information about the processing of your personal data by us at any time.
In this context, we will explain the data processing to you and provide you with an overview of the data stored about you. If data stored by us is incorrect or no longer up to date, you have the right to have this data corrected. You can also request the deletion of your data.
